補習班惡行惡狀誰來監督2009.6

筆者有一名南非的外國友人是英文老師，來台灣任教已超過七年之久，首度碰到惡老闆在無奈之下向我投訴，他任教於鳳山博愛路弘林外語短期補習班，該補習班的王姓女負責人兼主任，竄改合約書，所以合約書正本遲遲沒給他，並做不合理的要求，要求他離職後還要去上課，否則領不到薪資，他很疑惑，表示合約書至今年（98）5月31日已期滿離職，為什麼還要他6月6日當天再去上課，才能領到薪水，否則就不給他等言詞，他懷疑這合約書內容已被竄改，因此設計他6月6日當天再去上課，莫非要他違法去上課，按法令規定離職後，該負責人沒有理由要求他再去上課，如果再去上課等於是違法兼差，所以他拒絕上課，6月2日晚我陪同這位外籍友人到補習班去表明要拿薪水和合約書，該負責人王主任非常不悅，不但不願把合約給他，並叫小姐打電話給警察，叫警察把我們趕走，我們又沒犯法只好候駕，後來樓上又下來一名老師說請我們先回去，明天（3日）下午兩點再來一定把合約書還給他，結果還是騙他，當天王主任是拿一份影本要給他，他看完之後發現那一份合約書是被竄改過的，在空白處多出幾行字是補習班自己用打字上去的，不是當初合約書的真正內容，這已涉及他本身的權益問題因此他堅持要提告。

他又指出，補習班偽造當時的合約書被外師知道後，怕被外師提告，想設計陷害外師違法，告訴這名外師要在6月6日當天再去上課才要發薪水，身為教育單位的補習班惡行惡狀，除了帶給小朋友不良的身教外，對於不給及竄改合約書內容等種種的卑劣行為，留給外國老師的刻板印象，不禁要問台灣難道沒有法律，政府相關單位是如此的鬆散和推卸責任，讓他對台灣一些補教業感到失望。

6月3日早上筆者親自打電話到高雄縣政府勞工局，勞動條件科楊小姐表示，如有糾紛自行上網申訴，6月3日下午為什麼該補習班的負責人王主任可以隨叫隨到呢？難道只為補習班資方服務嗎？

據高雄縣政府教育處吳小姐表示：外師如果兼差已經是違法，至於薪資可要求勞工局協調，說好聽是部門分的很細，反之是互推皮球，縣府相關單位是否盡到監督責任，怎能讓如此惡劣的補習班胡作非為。

6月3日下午勞動組織科約僱人員戴小姐到補習班，該補習班王姓負責人拿出一張影印的合約書，外師一看是自已的簽名沒錯，但空白處多出幾行字是補習班自已再用電腦打上去的，所以王姓主任遲遲不肯給原先簽約的正本，但負責受理外勞諮詢服務及勞資爭議協調的戴小姐，當時向外師表示：即使要告也沒有證據等語，身為一個公務單位的約僱人員應該站在公正的立場來看待事情，怎能—面倒，意圖影響別人放棄告訴，這不是一個公務員該做的事。

I need to ask you to help me with a problem.
Last year I started working for an English cram school (Sprouts English Language School) in Fengshan City. When I negotiated with the school I was promised 18 hours a week at NT$600 per hour. Also I was promised NT$650 per hour if there was more than six students in the class. During the first month the school gave me these hours. From the second month they reduced it to 13 hours a week and also did not pay the NT$650 per hour even though some of the classes had more than six students. 

According to the law in Taiwan? this is below the minimum hours the school is suppose to give me. Later when hours did become available they also did not give these hours to me but instead gave it to another English teacher who is a friend of the principal. Te school also never paid me for public holidays, typhoon days or during Chinese New Year

When I started working there the school had me sign a paper with only one sentence namely that I am employed at the school from May 2008 to May 2009. They did not give me a copy of this document. Later when I asked for my contract they could only produce a photocopy of this document, not the original. They wrote additional information on this document that was not there when I signed the document. It was added afterwards

I have been living in Taiwan for eight years and am now unable to apply for an APRC even though I went to considerable expense to obtain all the documents necessary for my application. Because the school did not offer me the hours as promised I do not qualify to apply for permanent residency
